Additional Legal Resources 

The Albany County Bar Association (ACBA) is a privately funded trade organization for attorneys and the legal community in the NYS Capital District. The ACBA is not a public organization. Despite our name, the ACBA is not a government agency nor is it connected to the NYS Courts system. As such, we can not answer questions regarding issues or appearances with any court. We do not offer legal advice or pro bono services. We do not have attorneys on staff. Below please find a listing of possible legal resources, categorized by subject. Any information available on this website is for general legal education purposes only and is not legal advice. We take no responsibility for the accuracy of these resources. 

For clarity, a public defender and/or assigned counsel is an attorney who is court appointed by a judge. A pro bono attorney from an organization such as The Legal Aid Society or the The Legal Project, etc., is funded via grants and private donations and works almost exclusively on civil matters, not criminal matters. 

The public has access to law libraries in courthouses across the state. The law library in Albany County is called Francis Bergan Law Library and is located on the 4th floor of the Albany County Supreme Courthouse.

About the NYS Unified Courts
3rd Judicial Department by County and City


Supreme CourtThe Supreme Court is the state-wide trial court with the broadest jurisdiction, both in criminal and civil matters. It can hear virtually any type of case brought before it, with the exception of claims brought against the state which must be heard by the Court of Claims. However, it generally hears only cases that are outside the jurisdiction of other trial courts of more limited jurisdiction. The Supreme Court must be involved in proceedings to end a marriage since it is the only court which can grant divorce, annulment, and separation. As noted above, the Supreme Court is broken into twelve judicial districts state-wide. Justices of the Supreme Court are elected to serve 14-year terms.

Surrogates CourtThe Surrogate's Court of the State of New York handles all probate and estate proceedings in the New York State Unified Court System. All wills are probated in this court and all estates of people who die without a will are handled in this court. Unclaimed property of the deceased without wills is handled by the Judge of this court.
